Acuatic Vacuum Steriliser Distributor Terms and Conditions of Sale and Guarantee
1. GENERAL
All orders that are accepted by Sterling Sterilisers Ltd ("us") and any steriliser that is supplied by us is subject to these Terms and Conditions of Sale and Guarantee. Any contract between us and the Purchaser (“you”) is constituted by our acceptance of your order.
2. DELIVERY
Delivery of the steriliser shall be deemed to have been effected when the steriliser has been collected by you or delivered to your place of business or such other place as you have specified in your order. We will use all reasonable endeavours to effect delivery of the steriliser on the agreed date and time of delivery quoted but we shall not be liable for any loss or damage whatsoever arising directly or indirectly from any failure to effect delivery on such date or time.
3. PRICE AND PAYMENT
The price for the steriliser shall be the price quoted by us. Payment for the purchase of the steriliser shall be due and payable in advance. Payment may be made by BACS or cheque.
4. TITLE TO GOODS
Until the payment due from you to us has been received in full the steriliser shall belong to us. If for any reason you or any other party has possession of the steriliser but has not paid for it in full, we reserve the right to retake possession of the steriliser at any time and for that purpose you or your customer grant us, our agents and employees a licence at any time to enter any premises where the steriliser is stored in order to recover it. You will be liable for any associated costs. Risk in the steriliser will pass to you on delivery.
5. GUARANTEE
All Acuatic Vacuum sterilisers are guaranteed by us from the date of purchase against defects arising in manufacture subject to the conditions outlined below for a period of five years. Any component forming part of the original steriliser which is found to be defective within five years of the date of purchase as a result of a manufacturing defect during normal usage of the steriliser will be replaced free of charge. Components replaced under the terms of the guarantee shall continue to have the benefit of the unexpired portion of the guarantee only. We shall not be liable for any consequential loss of any kind whatsoever arising directly or indirectly from any claim or from any source giving rise to a claim under this guarantee.
5.1 EXCEPTIONS
The guarantee shall not apply to defects which are judged by us as being caused by:
- the failure to have the steriliser serviced every six months
- dropping of the steriliser, careless handling or accident
- improper use of the steriliser not in accordance with the user instructions
- incorrectly completed repairs or servicing
- any act or omission which is unlawful or negligent
- the use of non-genuine Sterling Sterilisers parts
- repairs or servicing carried out by any person not authorised by us
- any modifications being performed outside the scope of normal servicing or repairs without our express approval
- damage, which is "secondary" and is a direct result of any primary damage or defect upon which no action or rectification has taken place
- deterioration of parts or consumable items which occur due to normal wear and tear
The guarantee shall not apply to the replacement of lost, defective or damaged SD memory cards.
The guarantee shall not apply to alleged defects which are not a direct result of manufacturing defects or which do not affect the quality or function of the steriliser. These include but are not limited to:
- noises or vibrations which are considered to be representative of the characteristics of the steriliser
- gaps or any other defects which are considered to be representative of the permitted manufacturing tolerances accepted by us
- external appearance defects which are considered to be of a minor cosmetic nature by us and which have no significant effect upon the general appearance or quality of the steriliser or which are representative of the standards of finish expected by us
The guarantee shall not apply to the replacement of consumable or wear and tear items normally replaced or repaired in the process of servicing. These items have a limited life and shall be guaranteed against manufacturing defect for a limited period or usage only. "Wear and tear" is deterioration which occurs through usage where no evidence of a manufacturing defect is evident or where the normal useful life of such components, as judged by us, has expired. These components include but are not limited to:
- door seals
- solenoid valve plungers
- air intake filters
- chamber filters
- vacuum pump service kits
5.2 CLAIMS
Any parts that are supplied by us under the terms of this guarantee will be invoiced to you. Any parts that are returned to us and judged by us to be covered by the terms of this guarantee will be credited to you.
6. LIABILITY
We shall not be liable for:
- any indirect damages or losses including any loss of profits or revenue which may be caused by the steriliser not working
- any damage to any property caused by water or steam leaking from the steriliser
- any other consequential or economic loss arising from any malfunctioning of the steriliser
